PLEASE READ THIS TERMS AND CONDITIONS OF SERVICE AND USE AGREEMENT CAREFULLY. BY USING THIS WEBSITE OR ORDERING PRODUCTS AND SERVICES FROM THIS WEBSITE THE USER AGREES TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT.

Ltd., a company registered under the Companies Act, 2013 with registered office at A-92 C/3 Top floor Nambardar estate, New Friends Colony,110065[hereinafter “Puppiezo”],

AND

The user of this website, who agrees to the Terms and Conditions mentioned hereinbelow [hereinafter “User”];

Both Puppiezo and the User will collectively be referred to as “Parties”.

 

This Terms and Conditions of Service and Use Agreement ("Agreement") governs and regulates the Users use of this website, Puppiezo which inter alia includes the manner products and services are offered, purchased and the manner and use of information collected from the User. This Agreement includes, and incorporates by this reference, the policies and guidelines referenced below. Puppiezo reserves the right to change or revise the terms and conditions of this Agreement at any time by posting any changes or a revised Agreement on this Website. By accessing or using Puppiezo, the User warrant that he/she has read and reviewed this Agreement, and agree to be bound by the Terms & Conditions contained herein.

 

Puppiezo will alert the User about changes or revisions if changes have been made by indicating on the top of this Agreement the date it was last revised. The changed or revised Agreement will be effective immediately after it is posted on this Website. The User’s use of the Website following the posting any such changes or of a revised Agreement will constitute the User’s acceptance of any such changes or revisions. Puppiezo encourages the User to review this Agreement whenever the User visits the Website to make sure that the User understands the terms and conditions governing use of the Website. This Agreement does not alter in any way the terms or conditions of any other written agreement the User may have with Puppiezo for other products or services. If the User does not agree to this Agreement (including any referenced policies or guidelines), the User is requested to immediately terminate the Agreement.

 

  1. About Puppiezo

Puppiezo is an ecosystem of offerings of pet products, services and online marketplace which is engaged in the sale and marketing of household pets and products. We reserve the right of refusal of services or goods to anyone at our sole discretion to anyone for any reason at any time. 

 

  1. Products

Puppiezo offers inter alia the following products and services, which includes, pet products, pet foods, pet consultancy, veterinary services, pet services etc.

 

  1. Age Restriction and Other User qualifications

Users must be at least 18 (eighteen) years and competent to enter into an agreement to use Puppiezo or any services/ products contained herein. By using Puppiezo and agreeing to this Agreement, the User warrants that the User is/are over 18 years of age and competent to legally enter into this Agreement. Puppiezo assumes no responsibility or liability of misrepresentation on part of the User.

 

  1. License

Puppiezo may provide the User with certain information for use of the Website and for the selling/ marketing of products and services. Such information may include but is not limited to, documentation, data, or information developed by the Puppiezo, and other materials which may assist the User in using the Website or Services [“Puppiezo Property”]. Subject to these terms of the Agreement, Puppiezo grants the User a non-exclusive, limited, non-transferable and revocable license to use the Puppiezo Property solely in connection with the User’s use of the Puppiezo and services and products provided therefrom. Puppiezo Property may not be used for any other purpose and this license terminates upon the User’s cessation of use of Puppiezo or at the termination of this Agreement.

 

The User agrees not to collect contact information of other Users from the Puppiezo or download or copy any information by means of unsolicited access so as to communicate directly with them or for any reason whatsoever.

 

Any unauthorized use by the User shall terminate the permission or license granted to the User by Puppiezo. The User also agrees that they shall not bypass any measures used by Puppiezo to prevent or restrict access to the Website.

 

  1. Intellectual Property

The User agrees that the Website and all Services provided by the Puppeizo are the property of the Puppiezo, which includes all copyrights, trademarks, trade secrets, patents and other intellectual property ("Puppiezo IP"). The User agrees that Puppiezo owns all rights, titles and interests to Puppiezo IP and that the User will not use the Puppiezo IP for any unlawful or infringing purpose. The User agrees not to reproduce or distribute the Puppiezo IP in any way, including electronically or via registration of any new trademarks, trade names, service marks or Uniform Resource Locators (URLs), without express written permission from Puppiezo.

  1. In order to make the Website and Services available to the User, the User hereby grant the Puppiezo a royalty-free, non-exclusive, worldwide license to copy, display, use, broadcast, transmit and make derivative works of any content the User, uploads or otherwise makes available to the Website. Puppiezo claims no further proprietary rights in Your Content.
  2. In case of any grievance with the use of the content as specified in clause (a), the User is to contact Puppiezo atanalytics@puppiezo.com before proceeding with further action.

 

  1. User Obligations

In order to access the services and products provided by Puppiezo, the User may be required to register with Puppiezo. At the time of registration, the User will have to provide details about the User’s name, email address, phone number, and address, as well as a unique password created to enable the User to use Puppiezo. The User is responsible for ensuring the accuracy of this information. This identifying information will enable the User to use the Puppiezo in a manner that provides a more holistic experience. However, the User must not share such identifying information with any third party, and if the User discovers that such identifying information has been compromised, the User must notify Puppiezo immediately in writing (An email notification to hello@puppiezo.com would suffice). The User is responsible for maintaining the safety and security of the User’s identifying information as well as keeping Puppiezo apprised about any changes to the same.

The billing information the User provides Puppiezo, including credit card, debit card billing address and other payment information, is subject to the same confidentiality and accuracy requirements as the rest of the User’s identifying information. Providing false or inaccurate information, or using the Website or services to further fraud or unlawful activity is grounds for immediate termination of this Agreement. Puppiezo reserves the right to refuse service, terminate accounts, or remove or edit content in its sole discretion.

Puppiezo recognises the importance and appreciates the value of maintaining the User’s privacy. In order to safeguard the Privacy of the User’s and complying with the applicable law, Puppiezo gathers, uses and stores the User’s information in the following manner:

  1. Information that is gathered

Contact information:​ Puppiezo might collect the User’s name, email, mobile number, phone number, street, city, state, pin code, country and IP address.

Payment and billing information: Puppiezo might collect the User’s billing name, billing address and information pertaining to payment method. Puppiezo NEVER collects your credit/debit card number or credit/debit card expiry date or other details pertaining to your credit/debit card on the website. Credit/Debit card information will be obtained and processed by our online payment partners

Information you post: Puppiezo may collect information the User posts in a public space on the website or on a third­party social media site belonging to Puppiezo.

Demographic information: ​Puppiezo may collect demographic information about the User or any other information provided by the User during the use of Puppiezo. This information may be collected might as a part of a survey also.

Other information: ​In the course of the use of Puppiezo, Puppiezo may collect information about the User’s IP address and the browser used. Puppiezo might collect information regarding the amount of time spent on Puppiezo, and what pages were accessed or what site. Puppiezo might also collect the type of mobile device/computer the User is using. Further, other information also includes access to other Apps/websites which the User visits, that the User has permitted Puppiezo to access.

  1. Collection of Information

Information collected directly from User: Puppiezo collects information directly from the User, when the User registers with Puppiezo. Puppiezo also collects information when the User posts on the website or asks queries either through phone or email.

Information collected from User passively: Puppiezo uses tracking tools like Google Analytics, Google Webmaster, browser cookies, web beacons, etc for collecting information about the User’s use of Puppiezo.

Information about you from third parties: ​For example, if the User uses an integrated social media feature on Puppiezo. The third-party social media site will give Puppiezo certain information about the User. This could include the User’s name and email address.

  1. Use of Information

Puppiezo uses information to contact the User: ​ Puppiezo might use the information the User provides to contact the User for confirmation of a purchase on the website or for other promotional purposes.

Puppiezo uses information to respond to User requests or questions.

Puppiezo might use User information to confirm registration or purchase/order of any product or service.

Puppiezo uses information to improve products and services.​ Puppiezo might use User information to customize User experience. This could include displaying content based upon User preferences.

Puppiezo uses information to look at site trends and customer interests.​

Puppiezo may use User information to make the Puppiezo website and products better. Puppiezo may combine information received from the User with information about User received from third parties.

Puppiezo uses information for security purposes.​ Puppiezo may use information to protect Puppiezo, Puppiezo customers, and Puppiezo’s websites.

Puppiezo uses information for marketing purposes.​ Puppiezo might send User’s information about special promotions or offers.

Puppiezo might also tell User’s about new features or products. These might be Puppiezo’s own offers or products, or third­party offers or products which the User might find interesting.

Puppiezo uses information to send User’s transactional communications.​ Puppiezo might send User’s emails or SMS about their account or purchases.

Puppiezo uses information as otherwise permitted by law.

  1. Sharing Information with third-parties

Puppiezo may share information with:

  1. Third parties performing services on our behalf;
  2. With product manufactures, service providers who are business partners of Puppiezo;
  3. With law enforcement agencies to comply with law or protect Puppiezo;
  4. With successors to any or part of our business; and
  5. With any person/ entity for a reasonable reason.
  6. Opt-Out

The User may at any time request Puppiezo to stop sending marketing mails, to do so the User must contact: hello@puppiezo.com

  1. Duration

Puppiezo will have access to this information for the duration through which the User is registered with Puppiezo and has not terminated/permanently closed their account with Puppiezo.

 

  1. User Information

Puupiezo may assign the User a password and account for identification, to enable the User to access and use certain portions of the website. Each time the User uses a password or identification, the User will be deemed to be authorized to access and use the website in a manner consistent with the Terms and Conditions of this Agreement.

Puppiezo has no obligation to investigate the authorization or source of any such access or use of the website. The User is solely responsible for protecting the security and confidentiality of the password and identification assigned and for restricting access to the User’s computer, and the User agrees to accept responsibility for all activities that occur under their account or password.

The User shall immediately notify Puppiezo of any unauthorized use of your password or identification or any other breach or threatened breach of this website's security.

The User will be solely responsible for all access to and use of the website by anyone using this password and identification whether or not such access to and use of this site (including all obligations, communications and transmissions) is actually authorized by the User.

Puppiezo reserves the right to refuse service, terminate accounts, and/or cancel orders at its discretion, including, without limitation, if  Puppiezo believes that the conduct by the User violates applicable law or is harmful to website.

  1. Acceptable Use

The User agrees not to use the Puppiezo for any unlawful purpose or any purpose prohibited under this clause or any purpose that is prohibited by law. The User agrees not to use the Puppiezo in any way that could damage the website, Services, products or general business of Puppiezo. The User further agrees not to use Puppiezo:

  1. To harass, abuse, or threaten others or otherwise violate any person's legal rights;
  2. To violate any intellectual property rights of Puppiezo or any third party;
  3. To upload or otherwise disseminate any computer viruses or other software that may damage the property of another;
  4. To perpetrate any fraud;
  5. To engage in or create any unlawful gambling, sweepstakes, or pyramid scheme;
  6. To publish or distribute any obscene or defamatory material;
  7. To publish or distribute any material that incites violence, hate or discrimination towards any group;
  8. To unlawfully gather information about others.

 

The User is prohibited from using the site or its content:

  1. for any unlawful purpose;
  2. to solicit others to perform or participate in any unlawful acts;
  3. to infringe on any third party's intellectual property or proprietary rights, or rights of publicity or privacy, whether knowingly or unknowingly;
  4. to violate any local, federal or international law, statute, ordinance or regulation;
  5. to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
  6. to submit false or misleading information or any content which is defamatory, libelous, threatening, unlawful, harassing, indecent, abusive, obscene, or lewd and lascivious or pornographic, or exploits minors in any way or assists in human trafficking or content that would violate rights of publicity and/or privacy or that would violate any law;
  7. to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet;
  8. to collect or track the personal information of others;
  9. to damage, disable, overburden, or impair the Website or any other party's use of the Website;
  10. to spam, phish, pharm, pretext, spider, crawl, or scrape;
  11. for any obscene or immoral purpose; or
  12. to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet;
  13. to personally threaten or has the effect of personally threatening other Users. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

Puppiezo has the authority to review all content posted by the User on the Website. The User acknowledges that the Puppiezo is not responsible or liable and does not control the content of any information that may be posted to the Website by User or any other user of the Puppiezo, and User/other user is solely responsible for the same. The User shall not upload, post, or transmit any content that the User does not have a right to make available (such as, the intellectual property of another party).

The User agrees to comply with all applicable laws, statutes and regulations concerning use of the Puppiezo and further agrees that the User will not transmit any information, data, text, files, links, software, chats, communication or other materials that are abusive, invasive of another's privacy, harassing, defamatory, vulgar, obscene, unlawful, false, misleading, harmful, threatening, hateful or racially or otherwise objectionable, including without limitation material of any kind or nature that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable local, state, provincial, national, or international law or regulation, or encourage the use of controlled substances.

Puppiezo may, but have no obligation to, monitor, edit or remove content that is determined at the sole discretion  of Puppiezo to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates anyones  intellectual property or these Terms of Service.

The User may not use Puppiezo Property for any illegal or unauthorized purpose nor may the User, in the use of any service/product provided by Puppiezo, violate any laws (including but not limited to intellectual property right laws).

 

  1. Links to Other Sites

The website may contain links to third party websites. Any outside links are provided only as a convenience. The User’s use of outside links is at their sole risk. Links from the website do not constitute Puppiezo’s endorsement of any third party, its website, or its goods or services. Puppiezo is not responsible for any outside sites, services or other materials linked to or from the website, and disclaims all liability for any injury the User may experience by using such materials.

 

  1. Payment

In the event that the User registers for any of the paid services or products that Puppiezo offers, the User agrees to pay Puppiezo the specific monetary amounts required for that product or those services. These monetary amounts/Fees will be described to the User at the time of account registration and/or payment confirmation process. The final amount required for payment will be shown to the User immediately prior to purchase. Payment for any on-going Services is billed automatically to the User until Puppiezo is notified that the User would like to terminate such service.

Puppiezo reserves the right to refuse service or refuse to sell the products on the Website at their sole discretion to anyone for any reason at any time.

 

  1. Taxes

The User shall be responsible for payment of all fees/costs/charges associated with the purchase of products from Puppiezo and the User agrees to bear any and all applicable taxes including but not limited to VAT/CST, service tax, GST, duties, cesses and alike. Any additional taxes, duties and alike that the corresponding Govt. and/or statutory bodies shall levy in future to be exclusively borne by the User, to which affect, accent is obtained hereto.

  1. Guarantees and Warranties

To the extent permitted by law, Puppiezo excludes all warranties, representations and guarantees (whether express, implied or statutory), and we will not be liable for any damages, losses or expenses, or indirect losses or consequential damages of any kind, suffered or incurred by the User in connection with your access to or use of this website or the content on or accessed through it.


This disclaimer of liability also applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorised access to, alteration of, or use of record, whether for breach of contract, tortuous behaviour, negligence, or under any other cause of action.

 

  1. Indemnification

The User shall indemnify and hold harmless Puppiezo, its owner, licensee, affiliates, subsidiaries, group companies (if any) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of breach by the User of this Agreement, or violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) of a third party by the User.

 

  1. Shipping, Delivery, Cancellation and Return Policy

The User agrees to ensure payment for any items that may be purchased from Puppiezo and the User acknowledges that prices are subject to change. When purchasing a physical good, the User agrees to provide Puppiezo with a valid email and shipping address, as well as valid billing information. Puppiezo reserves the right to reject or cancel an order for any reason, including errors or omissions in the information provided by the User. If Puppiezo cancels an order after payment has been processed, Puppiezo will issue a refund to the User in the amount of the purchase price. Puppiezo also may request additional information from the User prior to confirming a sale and Puppiezo reserves the right to place any additional restrictions on the sale of any product/service. For the sale of physical products, Puppiezo may preauthorize the User’s credit or debit card at the time the User places the order or simply charge the card upon shipment. The User agrees to monitor the method of payment, they have chosen, and apprise Puppiezo in case of any issue with payment. Shipment costs and dates are subject to change from the costs and dates the User is quoted due to unforeseen circumstances.

Cancellation

In case of requests for order cancellations, Puppiezo reserves the right to accept or reject requests for order cancellations for any reason. For the User to cancel an order, there is a time period of 24 hours from the time you place the order. As part of usual business practice, if Puppiezo receives a cancellation notice and the order has not been processed / approved by Puppiezo, Puppiezo shall cancel the order and refund the entire amount with-in 15-20 working days.

Puppiezo will not be able to cancel orders that have already been processed.

Puppiezo has the full right to decide whether an order has been processed or not. The User agrees not to dispute the decision made by Puppiezo and accept Puppiezo’s decision regarding the cancellation.

 

Cancellation by Puppiezo

Puppiezo has the right to cancel or refuse the order for any reason. Some situations that may result in the User’s order being cancelled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by Puppiezo’s credit and fraud avoidance department. Puppiezo may also require additional verifications or information before accepting any order. Puppiezo will contact the User if all or any portion of the order is cancelled or if additional information is required to accept the order. If the User’s order is cancelled after the User’s credit card has been charged, the said amount will be reversed back in the User’s Card Account.

 

Return

  1. In case the User wishes to return a product, where the product is a pet product, the User must do so within 7 days of receiving the product, along with photographic evidence to show that the product is defective. If the product is found to be defective, Puppiezo would refund the entire amount within 30 days. Reimbursement would be provided using the same payment method through which payment was received.
  2. In case the User wishes to rehome/ put up/ return for adoption a pet, the User will not be entitled to a refund.

 

  1. Termination

Puppiezo reserves the right to terminate the User’s access to Puppiezo without any cause or notice. This may result in the forfeiture and destruction of all information associated with the User. In such an event, the Terms of Use shall come to an end. However, the Indemnification, Disclaimer, Governing Law, Jurisdiction and Dispute Resolution and Privacy Policy shall survive such termination.

 

  1. Entire Agreement

This Agreement constitutes the complete agreement and sets forth the entire understanding between the User and Puppiezo as to the subject matter of this Agreement. If any provision of this Agreement is found by any court of competent jurisdiction to be invalid or unenforceable, the invalidity of such provision shall not affect the other provisions of this Agreement, and all provisions not affected by such invalidity shall remain in full force and effect. The headings contained in this Agreement are for convenience of reference only and shall not affect the meaning and interpretation of this Agreement.

 

  1. Disclaimer

The User acknowledges and undertakes that the User is accessing the services on the site and transacting at their own risk and are using their best and prudent judgment before entering into any transactions through Puppiezo. If you are dissatisfied with the website, any contents, or any of these Terms and Conditions, Puppiezo would like to hear from you. However, the User’s only legal remedy is to stop using the website. Puppiezo does not warrant your use of the Site.

 

  1. Governing Law, Dispute Resolution and Jurisdiction

Any dispute arising out of any matter or dispute which arises from the terms of the Agreement, or any dispute that arises between Puppiezo and the User would be governed by the laws of Union of India. In case of any litigation or dispute, the Parties agree to submit to the exclusive jurisdiction of the appropriate courts of New Delhi, India.

This provision is a mandatory provision, and the User hereby waive the right to object to the venue, including the assertion of the doctrine of non-conveniens or similar doctrine.

 

  1. Errors

There may be information on our site that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, transit times and availability. Puppiezo reserves the right to correct any errors, inaccuracies or omissions and to change or update information without prior notice (including after you have submitted your order).

 

In the event a product is listed at an incorrect price or with incorrect information due to a typographical error or error in pricing or product information, Puppiezo shall have the right to refuse or cancel any orders placed for the product listed at the incorrect price whether or not the order has been confirmed and the User’s credit card has been charged. If the User’s credit card has already been charged for the purchase and your order is cancelled, Puppiezo shall immediately issue credit in the amount of the charge.

 

By accepting these Terms of Use, the User agrees to have fully read and understood all the terms and conditions set out hereinabove.
